Rental Agreement
Version 2.0 · Effective July 2026 · Everything Chris, Jamaica
⚠️ This is a legally binding agreement. By completing your booking and submitting your digital signature, you agree to all terms below. Your signature, uploaded government-issued ID, and the timestamp of agreement are retained on file and may be used in any legal proceeding arising from this rental.
1. Parties
This Rental Agreement ("Agreement") is entered into between Everything Chris ("we", "us", "the Company") and the customer whose name, government-issued ID, and digital signature appear on the completed booking form ("you", "the Customer").
2. Equipment Rental
We agree to rent to you the items listed in your confirmed booking ("Equipment") for the dates and at the address specified. Rental fees are charged per day as shown at checkout. All prices are in Jamaican Dollars (J$).
3. Deposit and Payment
- A deposit (the percentage shown at checkout) is required to confirm your booking. Your booking date and Equipment are not secured until the deposit is received.
- The outstanding balance is due on or before delivery. We reserve the right to withhold delivery if the balance has not been received.
- Deposits are generally non-refundable except where we are unable to fulfil the booking through our own fault.
4. Delivery, Setup and Collection
- We will deliver and set up the Equipment at the agreed address on the agreed date. A responsible adult must be present at delivery and at collection.
- Delivery fees apply based on your selected zone and are shown at checkout.
- You are responsible for ensuring safe, clear access to the event location for our crew and vehicle.
5. Customer's Responsibility for Equipment & Replacement Costs
From the moment Equipment is delivered until the moment it is collected by our crew, you are fully responsible for its safekeeping and condition.
- Damage and Destruction: If any Equipment is returned damaged beyond normal wear, or is destroyed, you are responsible for the full cost of repair or replacement. Normal wear means minor surface scratches consistent with careful, ordinary use. Broken frames, torn fabric, cracked surfaces, electrical damage, and water damage are not normal wear and constitute damage/destruction.
- Loss or Theft: If any Equipment is lost, stolen, or not returned for any reason, you are responsible for the full replacement cost.
- Definition of Replacement Cost: The replacement cost is calculated as the current local retail market cost to purchase a new, identical item.
If the item is not available in the local market, you are responsible for the purchase cost of the item from an international supplier PLUS all associated shipping, freight, customs clearance fees, import duties, and taxes required to land the replacement item in Jamaica.
- Third-party actions: You are fully responsible for Equipment damaged, lost, or stolen by your guests, attendees, or any other third party while it is in your care.
- Electrical equipment: All electrical items must be kept dry, sheltered, and operated within their rated capacity. Damage from water or overloading is chargeable.
6. Liability for Theft — Criminal and Civil
Theft of Equipment, or assisting or allowing others to steal Equipment, constitutes a criminal offence under the Larceny Act of Jamaica and may be reported to the Jamaica Constabulary Force. We will pursue all available civil remedies, including claims for the full replacement value of stolen items plus any associated legal costs, against the individual identified by the government-issued ID submitted with this booking.
7. Identity Verification and Accountability
- You confirm that the government-issued ID you uploaded is genuine, belongs to you, has not been altered or tampered with, and was valid and unexpired at the time of upload.
- Submitting a false, expired, or forged identity document is a criminal offence under the Forgery Act and other applicable laws of Jamaica and may result in immediate cancellation, forfeiture of all payments made, and referral to the relevant authorities.
- Your identity information is used solely to establish accountability for rented Equipment and is processed in accordance with our Privacy Policy and the Data Protection Act 2020.
8. Changes and Cancellations
- Contact us on WhatsApp as early as possible if your plans change. Rescheduling to an available date is usually possible with sufficient notice.
- Cancellations with less than 48 hours' notice may result in forfeiture of the deposit.
- We reserve the right to cancel a booking if we determine that an ID is fraudulent, the booking information is materially false, or we have reasonable grounds to suspect misuse of Equipment.
9. Disclaimer, Release of Liability, and Indemnity
⚠️ READ CAREFULLY: ASSUMPTION OF RISK AND WAIVER OF LIABILITY
- Assumption of Risk: You acknowledge that the rental, setup, use, and dismantling of event equipment (including but not limited to tents, chairs, tables, speakers, and lighting) involves inherent risks of property damage, personal injury, or death. You voluntarily assume all risks associated with the equipment while in your possession or on your premises.
- Release and Waiver: To the maximum extent permitted by Jamaican law, you release, waive, and discharge Everything Chris, its owners, employees, and agents from any and all liability, claims, or demands for personal injury, death, or property damage arising out of or related to the rental, delivery, installation, operation, presence, or removal of the Equipment, whether caused by the negligence of the Company or otherwise.
- Indemnification: You agree to defend, indemnify, and hold harmless Everything Chris and its representatives from any and all claims, lawsuits, damages, liabilities, losses, and expenses (including attorney fees) brought by your guests, attendees, or any third party for personal injury, death, or property damage resulting from the use, placement, or presence of the Equipment during the rental period.
- Use and Safety: You agree to use the Equipment solely for its intended purpose and in a safe manner. You shall not modify the Equipment. Tents and outdoor equipment must be evacuated in severe weather (such as high winds or storms) to prevent collapse or injury, and the Company is not responsible for injuries occurring during such events.
10. Electronic Signature
You acknowledge that your digital signature submitted through our booking platform constitutes a valid and legally binding signature under the Electronic Transactions Act 2006 (Jamaica) and carries the same legal weight as a handwritten signature.
11. Governing Law and Jurisdiction
This Agreement is governed by the laws of Jamaica. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Jamaica.
12. Entire Agreement
This Agreement, together with your booking confirmation, constitutes the entire agreement between the parties regarding the rental of Equipment and supersedes any prior verbal or written representations.
